Scarcity has moved from the orebody to the plant. CBP CSMS 69711865 of 31 August 2026 makes the copper primary country of smelt and country of cast mandatory on entry summaries from 14 September 2026, with error F794 returned as fatal in ACE. The obligation comes from Proclamation 11021 of 2 April 2026 (91 FR 18201, published 9 April 2026), clause 20; mechanics in CBP CSMS 69252300 of 15 July 2026, fields live 30 July. The proclamation attaches duty to the answer: clause 2 sets an additional ad valorem rate of 50 per cent for Annex I-A articles, clause 3 sets 25 per cent for Annex I-B, both reduced to 10 per cent where the copper was smelted and cast entirely in the United States; clause 13 opens manufacturing drawback for copper smelted and cast in a listed trade agreement partner country. A spread of up to 40 percentage points therefore turns on smelt and cast location. The deployed requirement covers four tariff lines, 8544.42.10, 8544.42.20, 8544.42.90 and 8544.49.10, all insulated wire and cable under HTSUS heading 8544; cathode, wire bar and rod are not covered, and importers may report OTH (other) where the country of smelt or cast is unknown, so the record does not measure where American refined copper comes from. For 2024 the numerator is 807 thousand tonnes (refined imports 810, less refined exports 60, plus a 57 thousand tonne draw on refined stocks from 127 to 70) against apparent consumption of 1,807, giving 44.7 per cent, rounded by the survey to 45. Every term is refined metal; mine output does not enter the figure. Without the stock adjustment the same year reads about 41.5 per cent, where the survey puts 2022 and 2023. Exports of ore and concentrate were 383, 344, 351, 339 and 320 thousand tonnes for 2020 to 2024; refined imports rose from 676 to 810; refinery production from ore was 872 in 2020 and 850 in 2024. Three month LME copper was 13,290 dollars on the day the ICSG figure was reported. The study argues a surplus that small cannot be load bearing for price, and that the concentrate constraint underneath is the number that moves. Published 23 August 2026.
